Welcome to Sunday Sauce. These Terms of Service ("Terms") govern your access to and use of the Sunday Sauce mobile application ("App") operated by Sunday Sauce LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to create an account and use the App. If you are between 13 and 17 years old, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. The App is not directed at children under 13, and we do not knowingly collect personal information from children under 13.

2. Description of Service

Sunday Sauce provides AI-powered interactive cooking sessions. The App features cooking guides — AI-generated characters that walk you through authentic recipes from cultures around the world in real-time voice conversations.

AI Disclosure

The cooking guides in Sunday Sauce are not real people. They are AI-generated characters. The guides are powered by Claude, a large language model developed by Anthropic. Speech recognition is provided by Deepgram. Guide voices are synthesized using Cartesia text-to-speech technology. Real-time audio sessions are delivered through LiveKit.

While the guides are designed to be culturally knowledgeable and to provide authentic cooking instruction, they are artificial intelligence systems. Their responses are generated by AI and may contain errors, inaccuracies, or omissions.

3. User Accounts

To use certain features of the App, you must create an account. You may sign in with Apple or with your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

You may delete your account at any time through the App's settings. Upon deletion, your account data will be removed in accordance with our Privacy Policy.

4. Session Credits and Purchases

Cooking sessions require session credits. Credits are consumable in-app purchases processed through the Apple App Store. Credits are not subscriptions — they do not auto-renew.

• Credits are deducted when you start a cooking session.
• Purchased credits do not expire.
• Credits are non-transferable and cannot be exchanged for cash.
• Refunds are handled by Apple in accordance with Apple's refund policies.

All payment processing is handled by Apple. We do not collect or store your payment card information. Your purchase is subject to Apple's Licensed Application End User License Agreement.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to extract harmful, offensive, or dangerous content from the AI guides.
• Record, redistribute, or commercially exploit session content without our written permission.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Interfere with or disrupt the App's infrastructure or other users' experience.
• Create multiple accounts to circumvent restrictions or abuse promotional offers.

We reserve the right to suspend or terminate your account for violations of these Terms.

6. Intellectual Property

All content, features, and functionality of the App — including text, graphics, logos, recipes, cultural content, AI-generated material, character designs, and software — are owned by Sunday Sauce LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a non-exclusive, non-transferable, revocable, limited license to access and use the App solely for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from App content without our prior written consent.

Sunday Sauce, the Sunday Sauce logo, and all related marks are trademarks of Sunday Sauce LLC.

7. Cooking and Food Safety

Sunday Sauce provides cooking guidance for educational and entertainment purposes only. You acknowledge and agree that:

• You cook at your own risk and discretion. We are not responsible for domestic accidents, including but not limited to burns, cuts, fires, or injuries from cooking implements.
• You should always follow standard food safety practices, including proper handling of raw ingredients such as eggs, chicken, and seafood.
• Results may vary due to differences in ingredients, equipment, altitude, humidity, cooking temperatures, and individual ability.
• We are not liable for adverse reactions to food consumed, including food allergies, food-borne illness, or any kind of food-related health issue.
• You should review all ingredients before cooking to be aware of potential allergens. We cannot guarantee that any recipe is safe for people with allergies.
• If you have dietary restrictions, allergies, or health concerns, consult your medical professional before following any recipe.

8. AI Content Disclaimer

AI-generated cooking content may contain errors, inaccuracies, or omissions. You acknowledge and agree that:

• AI-generated recipes, instructions, and nutritional information have not been formally tested or verified and should not be relied upon as authoritative.
• AI-generated nutritional information is estimated and may not be accurate. Do not rely on this information for medical dietary requirements.
• AI-generated cooking instructions may not reflect current food safety standards. Always follow USDA and relevant local food safety guidelines.
• The App is not a substitute for professional culinary, nutritional, or medical advice.
• You should independently verify cooking temperatures, times, and food safety guidance, particularly for preservation, canning, or recipes involving raw preparations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUNDAY SAUCE LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. For consumers in the EU/EEA or UK, your statutory rights under applicable consumer protection laws are not affected by these Terms.

10. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Sunday Sauce LLC from any losses, claims, liabilities, and costs (including reasonable attorneys' fees) arising from: (i) your use or misuse of the App; (ii) your violation of these Terms; (iii) your violation of any third-party rights; or (iv) any content you submit through the App.

11. Third-Party Services

The App integrates with third-party services including Apple App Store, Anthropic (AI processing), Deepgram (speech recognition), Cartesia (voice synthesis), LiveKit (real-time communication), and RevenueCat (purchase management). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

12. Modifications

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App ends immediately. Sections 6 through 11 survive termination.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
